Specific deliverables, timelines, and pricing are agreed upon in a separate service agreement or proposal.

3. Eligibility

You must be at least 18 years of age and have the legal authority to enter into a binding agreement to use our services. By using our services, you represent and warrant that you meet these requirements.

4. Communications Consent

By submitting your contact information through our website, booking forms, or other intake processes, you agree to receive communications from StratPoint Solutions LLC (dba StratPoint Marketing Solutions), which may include:

• Appointment confirmations and reminders via SMS and/or email
• Follow-up messages related to your inquiry or service engagement
• Marketing and promotional communications (if you have opted in)

Email Opt-Out: You may unsubscribe from marketing emails at any time using the unsubscribe link in any marketing email or by contacting us directly.

5. Payment Terms

All fees for services are outlined in your service agreement or proposal. Payments are processed securely through our payment processor (Stripe). By providing payment information, you authorize us to charge the agreed amounts per the terms of your agreement.

• Monthly subscription fees are billed on a recurring basis unless cancelled
• Annual plan fees are billed upfront for the full contract period
• Refunds are subject to the terms outlined in your individual service agreement
• Late or failed payments may result in suspension of services

6. Cancellation Policy

Clients on monthly plans may cancel services with written notice in accordance with their service agreement. Annual contracts may be subject to early termination fees as specified in the agreement. Cancellation requests must be submitted in writing to info@stratpointsolutions.com.

7. Intellectual Property

All content on our website — including text, graphics, logos, images, and code — is the property of StratPoint Solutions LLC (dba StratPoint Marketing Solutions) or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

Work product created specifically for a client under a paid service agreement becomes the client's property upon full payment, unless otherwise specified in writing.

• Respond to communications in a timely manner to avoid delays in deliverables
• Ensure that any content, materials, or data you provide to us does not infringe on the intellectual property or rights of any third party

9. Disclaimer of Warranties

Our website and services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee specific business outcomes, revenue results, or lead volume. Marketing results vary based on many factors outside our control, including market conditions, competition, and client implementation.

10. Limitation of Liability

To the maximum extent permitted by law, StratPoint Solutions LLC (dba StratPoint Marketing Solutions) shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services or website, even if we have been advised of the possibility of such damages. Our total liability shall not exceed the amount paid by you for services in the three (3) months prior to the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless StratPoint Solutions LLC (dba StratPoint Marketing Solutions) and its officers, employees, and agents from any claims, liabilities, damages, or expenses (including reasonable attorney's fees) arising from your use of our services, your violation of these Terms, or your infringement of any third-party rights.

Both parties agree to keep confidential any proprietary or sensitive information shared during the course of the business relationship. This includes, but is not limited to, business strategies, customer data, pricing, and internal processes. This obligation survives the termination of services.

13. Third-Party Platforms

Our services may involve third-party platforms and tools (such as Google, Meta, Stripe, or marketing software). Your use of those platforms is governed by their respective terms and privacy policies. We are not responsible for third-party platform outages, policy changes, or performance.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in Collier County, Florida.

We reserve the right to update these Terms of Service at any time. Changes will be posted on this page with a revised "Last Updated" date. Your continued use of our services after changes are posted constitutes acceptance of the updated Terms.
